You understand and agree to the cancellation and rescheduling policies described in Section 6 of these terms and conditions, including any applicable fees or notice requirements.
F. Liability and Waiver:
You have read and understood the liability and waiver provisions outlined in Section 8 and acknowledge that participation in our training programs may involve physical exertion and carries inherent risks.
G. Privacy Policy:

By engaging in our personal training services, you acknowledge and agree to the terms and conditions outlined in Section 1.4 of this document, including but not limited to your commitment to personal fitness goals, compliance with training plans, health and safety considerations, payment obligations, cancellation and rescheduling policies, liability and waiver provisions, privacy policy, termination conditions, dispute resolution procedures, intellectual property rights, governing law, and acceptance of future amendments as specified.

2.3. "Services" - Encompasses all personal training services offered by Intuitive Body Lab, including but not limited to one-on-one training, small group training, and large group training.
2.4. "Training Program" - Describes the customized fitness program and exercise routines developed by the Trainer for the Client to achieve specific fitness goals.
2.5. "Fees" - Refers to the charges, payments, and costs associated with the provision of personal training services, as detailed in Section 5.
2.6. "Cancellation" - Denotes the act of notifying the Trainer in advance of a scheduled training session that the Client will not be attending.
2.7. "Rescheduling" - Refers to the process of changing the date or time of a scheduled training session in accordance with the policies outlined in Section 6.
2.8. "Privacy Policy" - Describes the document that outlines how client information is collected, used, and protected by Intuitive Body Lab, as detailed in Section 9.
2.9. "Liability and Waiver" - Pertains to the provisions in Section 8 regarding the release of liability and assumption of risk associated with personal training services.
2.10. "Termination" - Refers to the conditions under which either party may end the training relationship, as specified in Section 10.
2.11. "Dispute Resolution" - Encompasses the procedures for resolving conflicts and disputes outlined in Section 11.
2.12. "Intellectual Property" - Refers to any training materials, programs, or intellectual property developed during training sessions, as discussed in Section 12.

Section 3: Scope of Services
At Intuitive Body Lab, we offer a range of services tailored to help you achieve your fitness goals. Our services primarily focus on:
3.1. Body Composition Management: Our programs are designed to assist you in managing your body composition, whether your goal is weight loss, muscle gain, or overall body transformation.
3.2. General Health and Fitness: We are committed to improving your overall health and fitness levels, emphasizing wellness and vitality in addition to physical strength.
3.3. Building Lean Muscle Mass: For those seeking to build lean muscle mass, our training programs are structured to support muscle development while promoting a balanced and healthy lifestyle.
3.4. Training Venues:
All services are currently conducted from Intuitive Body Lab, 26 Eighth St, Mildura, Vic, Australia
3.5. Membership Options:
Group Sessions: Members have the option to participate in group training sessions, limited to a maximum of three sessions per week. Group sessions are scheduled on Mondays, Wednesdays, and Fridays, with specific times available via our online booking system.
One-on-One Services: Personal training services for one-on-one sessions are available six days a week, with Sundays being our designated rest day. Appointments for one-on-one sessions must be made by contacting us directly.
Our scheduling and venue options are designed to provide flexibility and convenience while ensuring that your fitness journey aligns with your unique goals and preferences. We are dedicated to helping you achieve your desired outcomes in a safe and supportive environment.
Section 4: Client Responsibilities
At Intuitive Body Lab, we believe that a successful fitness journey requires a collaborative effort between the client and the trainer. To ensure a productive and safe training experience, we outline the following client responsibilities:
4.1. Commitment to Training:
Clients are responsible for their commitment to their personal fitness goals and objectives. This includes maintaining dedication, motivation, and consistency throughout the training program.
4.2. Compliance with Training Plans:
Clients must adhere to the training plans, schedules, and recommendations provided by their trainer. Open communication with the trainer is encouraged to discuss progress and any necessary adjustments.
4.3. Health and Safety:
Clients are responsible for their own health and safety during training sessions. It is imperative to communicate any medical conditions, injuries, or concerns that may affect the ability to engage in physical activity.
4.4. Punctuality:
Clients should arrive on time for scheduled training sessions. Being punctual helps maximize the training time and ensures a consistent routine.
4.5. Attentiveness and Effort:
Clients are expected to be attentive during training sessions, actively participating in exercises, and putting forth their best effort to achieve desired results.
4.6. Communication:
Open and honest communication with the trainer is essential. Clients should provide feedback on their progress, concerns, or any changes in their health or fitness status that may impact training.
4.7. Payment Obligations:
Timely payment of fees, charges, or agreed-upon payment schedules, as outlined in Section 5, is the responsibility of the client.
4.8. Cancellation and Rescheduling:
Clients must adhere to the cancellation and rescheduling policies detailed in Section 6. Proper notice of cancellation or rescheduling is expected to avoid disruption.
4.9. Safety and Hygiene:
Clients should prioritize their safety and hygiene during training sessions, including the use of appropriate workout attire and equipment sanitation.
Section 5: Fees and Payment
At Intuitive Body Lab, we offer various membership options and payment arrangements for our services. Please review the following details regarding fees and payment methods:
5.1. Group Sessions Membership Fee:
The fee for group sessions membership is $64 per week, payable for a continuous period of seven days. This membership provides access to scheduled group training sessions.
5.2. 8-Week Program/Package Deal:
We offer an 8-week program/package deal designed to help you achieve your lifestyle goals. The details regarding fees and payment for this package are as follows:
Package Fee: The package fee for the 8-week program is designated with each program launch. This fee is payable in full before the program's commencement.
Payment Deadline: Payment must be made in full and received by us before the start date of the program.
Non-Refundable Package: Once the 8-week program has commenced, the package fee is non-refundable. We understand that unforeseen circumstances may arise, but due to the structured nature of the program, we are unable to provide refunds after the start date.
Cancellation Before Commencement: If, for any reason, you need to cancel your participation in the program before the start date, you may be eligible for a refund. Please contact us for further information and to discuss your situation.
Payment Methods: Payments for the package can be made via our online portal using direct debit or credit/debit card through Stripe.
5.3. Payment Method:
Payment for memberships is processed through our secure online portal using Stripe, allowing clients to use direct debit or credit/debit cards for payment.
5.4. Casual Visits/One-Off Sessions:
Clients may choose to attend individual sessions on a casual basis. The fee for casual visits or one-off sessions is $25 per visit. Please note that fees for casual visits are non-refundable.
5.5. Payment Schedule:
Payments for memberships, including group sessions and trial memberships, are processed on a recurring weekly basis, while casual visits are paid per visit.
5.6. Payment Authorization:
By engaging in our services, clients authorize Intuitive Body Lab to process payments as specified in these terms and conditions.
5.7. Fee Adjustments:
Intuitive Body Lab reserves the right to adjust membership fees and pricing for services. Clients will be notified in advance of any fee changes.
5.8. Payment Disputes:
If a dispute arises regarding a payment or charge, clients are encouraged to contact us directly to resolve the issue promptly and amicably.

Section 6: Cancellation and Rescheduling
At Intuitive Body Lab, we understand that scheduling conflicts and unexpected situations may arise. We have established the following policies regarding session cancellations, rescheduling, and membership holds:
6.1. Cancellation and Rescheduling of Sessions:
In the event that a group session or personal training session cannot proceed as planned due to unforeseen circumstances, an alternative session if none are available on the current schedule, will be arranged within 7 days of the canceled session. We strive to ensure that you receive the training you have paid for.
6.2. Membership Cancellation:
To cancel a membership, clients are required to provide 14 days notice in advance of their desired cancellation date. If a billing date falls within the notice period, the membership will be charged as per normal.
6.3. Membership Holds:
Clients have the option to place their membership on hold for a minimum period of 14 days. If your holidays, illness, or other circumstances require a shorter absence (less than 14 days), your membership will continue as per normal, and you will not be eligible for a hold during this time.
6.4. Request for Cancellation or Hold:
Requests for membership cancellations or holds must be made in writing and submitted to Intuitive Body Lab at least 14 days in prior to the request date. Requests can be sent via email or through the contact information provided in Section 1.5.
6.5. Fee Implications:
Membership fees will apply as per the regular billing cycle until the effective date of cancellation or hold. Any fees accrued within the notice period or during a hold period will be billed accordingly.
6.6. Communication:
Effective communication is essential for efficient session rescheduling and membership management. Clients are encouraged to promptly notify Intuitive Body Lab of any cancellations, rescheduling requests, or membership holds.

7.2. Medical Conditions and Disclosures:
Clients must provide accurate and complete information on the pre-screening form, including any known medical conditions, allergies, medications, or injuries. 7.3. Trainer Consultation:
In cases where significant medical conditions or concerns are disclosed on the pre-screening form, clients may be required to consult with a healthcare professional or our trainer before commencing training sessions. 7.4. Safety Guidelines:
Clients are expected to adhere to all safety guidelines and instructions provided by our trainers during training sessions. This includes using proper form and technique, using equipment safely, and following any specific safety recommendations.
7.5. Hydration and Nutrition:
Staying adequately hydrated and nourished is essential for your safety during training sessions. Clients are encouraged to maintain proper hydration and nutrition both before and after training.
7.6. Injury Reporting:
If you sustain an injury or experience any discomfort during a training session, it is your responsibility to inform the trainer immediately. This allows us to assess the situation and provide appropriate guidance or medical assistance if needed.
7.7. Personal Limits:
Clients should be aware of their personal physical limits and not push themselves beyond what is safe or comfortable. Our trainers are available to provide modifications and guidance as needed.
7.8. Emergency Procedures:
In the event of an emergency during a training session, clients should follow the instructions provided by our trainers to ensure safety and minimize risks.
7.9. Training Environment:
The training environment should be kept clean and organized. Clients are encouraged to assist in maintaining a safe and hygienic training space.

Section 8: Liability and Waiver

8.5. Responsible Behavior:
You agree to conduct yourself responsibly during training sessions, including following safety guidelines, using proper form, and respecting the instructions provided by trainers.
8.6. Indemnification:
You agree to indemnify and hold harmless Intuitive Body Lab, its trainers, staff, and affiliates from any claims, liabilities, damages, or expenses (including legal fees) arising from your participation in our services.
8.7. Parental or Guardian Consent (if applicable):
For clients under the age of 18, a parent or legal guardian must provide consent and acknowledge these liability and waiver provisions on their behalf.
8.8. Acknowledgment of Understanding:
By accepting these terms and conditions, you confirm that you have read, understood, and agree to the provisions outlined in this "Liability and Waiver" section. You acknowledge that participation in fitness activities carries inherent risks.

We do not sell, trade, or otherwise transfer your personal information to third parties without your consent, except as required by law.

Section 10: Termination

Clients have the right to terminate their training services with Intuitive Body Lab at any time for any reason. To initiate termination, clients must provide written notice of their intent to terminate via email or through the contact information provided in Section 1.5.
10.2. Termination by Trainer:
Intuitive Body Lab may terminate a client's training services only in the following circumstances:
Safety Concerns: If a client's participation in training sessions poses a safety risk to themselves or others, as determined by our trainers, and after reasonable efforts to mitigate the risk have been unsuccessful.
10.3. Refund Policy upon Termination:
In the event of termination by the client, any prepaid membership fees beyond the effective date of termination will be refunded on a pro-rata basis in accordance with Australian Consumer Law.
10.4. Disposition of Training Materials:
Upon termination, clients are entitled to retain copies of training materials provided to them during the course of their training program, subject to any applicable intellectual property rights outlined in Section 12.
10.5. Outstanding Obligations:
Termination does not relieve clients of any outstanding financial obligations, including unpaid membership fees, that were incurred prior to the effective date of termination.
10.6. Future Engagement:
Following termination, clients are welcome to re-engage in our training services at any time, subject to availability and adherence to our terms and conditions.
10.7. Dispute Resolution:
In the event of a dispute related to termination, clients and Intuitive Body Lab will follow the dispute resolution procedures outlined in Section 11 to seek an amicable resolution.

Section 11: Dispute Resolution
At Intuitive Body Lab, we value open communication and strive to resolve any issues or disputes that may arise promptly and amicably. This section outlines the procedures for resolving disputes between clients and Intuitive Body Lab:
11.1. Informal Resolution:
In the event of a dispute or disagreement related to our training services, clients and Intuitive Body Lab agree to first attempt to resolve the issue informally. This may involve direct communication between the client and our trainers or management to discuss the concern and seek a mutually acceptable resolution.
11.2. Formal Dispute Resolution:
If an informal resolution is not successful in resolving the dispute to the satisfaction of both parties, either the client or Intuitive Body Lab may initiate formal dispute resolution procedures.
11.3. Mediation:
Both parties agree to participate in mediation, facilitated by a neutral third party, to help mediate and resolve the dispute. The mediator's role is to facilitate communication, assist in understanding each party's perspective, and work towards a mutually agreeable solution.
11.4. Arbitration:
If mediation is unsuccessful in resolving the dispute, both parties agree to submit the dispute to binding arbitration in accordance with Australian arbitration laws. The decision of the arbitrator will be final and legally binding.
